What Is Mediation?

Mediation is a effective option of resolving disputes in a voluntary manner.  Both parties are actively involved in deciding the outcome and parameters of the agreement in a collaborative manner.  As the mediator in this process , we support the decision making process by acting as an unbiased facilitator to help the parties highlight the pertinent areas of disagreement, to provide information regarding relevant law, and to inform both parties of their rights and obligations.  If needed, the mediator may offer suggestions for both parties to consider, but will otherwise abstain from influencing the decision-making process. Both parties are offered the option to have legal counsel present during the mediation process.

 

While litigation and court costs can become excessively expensive, mediation is typically a cheaper and less time consuming alternative. Through mediation, both parties are able to streamline the resolution process to achieve a more satisfactory conclusion arrived at through mutual participation and consent.  Because both parties are involved in the mediation and decision-making process, they typically experience a strong sense of comfort and empowerment from knowing that they contributed to the outcome at their own pace and leisure without relying on an outside third-party decision maker.
